Early Years Excellence Academy

1. Application and agreement

1.1 These Terms and Conditions apply to the provision of the services detailed in our quotation by Early Years Excellence Academy LTD, a company registered in England and Wales under number 15888002, who’s registered officed is at Unit 10E, Knowle piece, Business centre , Wilbury Way, SG4 0TY

1.2 These Terms and conditions contain the entire agreement between parties and unless otherwise agreed in writing by the director of the Agency, these Terms and Conditions prevail over any other terms of business or purchase conditions put forward by the Client.

1.3 No Variation or alteration to the Terms and Conditions shall be valid unless the details of such variation are agreed between the Agency and the Client and are set out in writing and a copy of the varied terms if given to the Client stating the date on or after which such varied terms shall apply.

2. Fees

2.1 The Fees for the Services are set out in the quotation

2.2 The Fees are exclusive of any applicable VAT and other taxes or levies which are imposed or charged by any competent authority.

3. Cancellation and amendment

3.1 The Agency or Client can withdraw, cancel, or amend any quotation if it has not been accepted by either party.

3.2 The Agency or Client can cancel an order for any reason, providing a minimum of 10 days notice has been given.

3.3 The Agency or Client can amend an order for any reason, providing a minimum of 48 hours’ notice has been given.

3.4 The Agency or Client cannot cancel or amend an order for any reason (3.4.1),

within 48 hours of the training due to take place.

3.4.1 The Client can cancel within a 24-hour notice period with the only exception of an OFSTED inspection taking place.

4. Payment

4.1 The Agency will invoice you for payment of the fees.

4.2 The Client must pay the invoice at least 10 days before the training is due to take place, in accordance with any credit terms agreed between the Agency and the Client.

4.3 If the Client agrees to a quotation with less than 10 days to go to the training, payment must be made at the time of quotation being agreed by both parties.

5. Refund

5.1 In order to qualify for the refund, the Client must pay the Agency fee, no later than 10 days before the training is due to take place.

6. Liability

6.1 The Agency shall not be liable under any circumstances for any loss, expense, damage, delay costs or compensation (whether direct, indirect, or consequential) which may be suffered by the Client arising from or in any way connect with the Agency. For the avoidance of doubt, the Agency does not exclude liability for death or personal injury arising from its own negligence.

7. Law

7.1 The Terms and Conditions are governed by the law of England & Wales and are subject to the exclusive jurisdiction to the Courts of England & Wales.

Schedule: Scale of Refund

1. The following scale of refund ONLY applies in the event that the Client complies with the provisions of clause 5.1 of these Terms and Conditions.

When training is cancelled and refund available:

Less than 48 hours’ notice - No refund

More than 48 hours but less than 10 days’ notice - Training date can be amended

More than 10 days’ notice - Full refund
